The head of the Immigration Department has warned a campaign by premiers and refugee advocates to stop 267 asylum seekers being returned to Nauru is counter-productive and undermines authorities’ efforts to quietly let them stay.
People with cancer and terminal illnesses among those facing deportation, with Immigration Department Secretary Michael Pezzullo saying the first returns could take place within days.
Mr Pezzullo also rejected claims that a five-year-old boy was raped while in detention in Nauru, saying details of how it was reported were a “figment”.
During 90 minutes of questions, Mr Pezzullo also revealed the Federal Police had been called in to investigate the leaking of a Cabinet submission that flagged making it harder for refugees to gain permanent residency.
The Government has been under pressure from refugee campaigners and churches not to return to Nauru 267 asylum seekers brought to Australia for medical treatment following a High Court case last week which ruled the offshore detention of boat people was lawful. Thirty-seven babies born in Australia are among those facing deportation.
Over the weekend, Victorian Premier Daniel Andrews, NSW Premier Mike Baird, Queensland’s Annastacia Palaszczuk and ACT Chief Minister Andrew Barr offered to resettle the asylum seekers.
The Government has said decisions on returning people will be made on a case-by-case basis but Malcolm Turnbull has stressed he won’t water down the hard line stance because of the risk of re-starting the people smuggling trade.
Mr Pezzullo told Senate Estimates that no amount of “moral lecturing” would see the policy change but indicated the Department would exercise discretion and compassion “quietly”.
“There is no compassion in giving people false hope,” he said.
“For those transferees and refugees temporarily in Australia for medical treatment or accompanying those in need of treatment, they will be returned to Nauru and Papua New Guinea as the case applies at the conclusion of their treatment.
“Avoidance of fanfare and gesture is crucial lest others be encouraged to the game opportunities to get to Australia or stay here.
“Yielding to emotional gestures in this area of public administration simply reduces the margin for discretionary action which is able to be employed by those who are actually charged with dealing with the problem.”
Mr Pezzullo denied he was specifically referring to the premiers in his comments, saying that was for others to judge.
Asked about an ABC news report last week that alleged a five-year-old boy was raped while in detention, Mr Pezzullo said it was wrong.
“It’s a figment,” he said.
Departmental First Assistant Secretary Cheryl-Anne Moy told Estimates that she checked with the doctor in the report, Karen Zwi. She said Dr Zwi had never told the ABC the victim was five years old and did not know how it came to be reported that way.
Ms Moy said on cross-checking showed the victim was actually at least twice as old as reported, and the perpetrator was another asylum seeker child two years older. The assault involved “skin-to-skin contact”.
She said the department had been aware of the assault after it was reported by the boy’s parents, it had been investigated and the boy had been brought to NSW for treatment.
Mr Pezzullo said the Federal Police had been asked to investigate the leaking of a Cabinet document to the ABC and Fairfax Media on plans to toughen the humanitarian migration program.
Among the proposals were removing direct access to permanent residency and greater monitoring of new arrivals.
The document highlighted how the perpetrators of recent terror attacks in Australia had been refugees or dependants of new arrivals and lessons learnt from integrating Lebanese Muslims after the wave of migration in the 1970s and 80s. It flags concerns some of the 12,000 Syrian refugees to be resettled here may have violent tendencies.
Mr Pezzullo said draft and finished versions of the document had not been sent to Immigration Minister Peter Dutton’s office.
Australian Border Force Commissioner Roman Quaedvlieg said the success of Operation Sovereign Borders had seen people smugglers slash the price of passage to Australia in a desperate hunt for customers. Intelligence indicated fares had dropped from $US10,000 to $US2000 per person.
Something more for the self proclaimed moral preachers to consider including the ABC (again), a church group and those state premiers who think that responsibility for national security ends at the state boundary.

With the specific issue above, the ABC has acknowledged its error (again).

Two generations of Syrians are pretty much destroyed. The Third generation might slowly get back on their feet and be lucky if they have enough to eat. The fourth can go to school again.
Is it not true the whole problem in Syria is all about religion.....Muslims fighting Muslims.....Suunies V Shiite for dominance....ISIS interference.....intervention by Russia and the West
And when it all settles down and they sort themselves out the West will come in and invest $billions to rebuild the destruction they created....There will be plenty of work in Syria in the years to come.

In their desire to report negatively on the current government's border protection policies, they get facts wrong. This is a lack of due diligence in the accuracy of their reporting driven by their bias. For a taxpayer funded broadcaster, it's very poor indeed.I don't agree with your assessment that the ABC shows a bias towards any particular political faction...castor oil tastes bad and always comes with protest. However I do take umbrage with the talking heads on their Breakfast show, especially the pompous Virginia and her inflated sense of self worth.
Everyone is aware that that Mark Scott's DNA is rooted deeply in the Liberal Party? He was (and probably still is) a Liberal Party adviser and served as chief of staff in the Griener Govt?
Insofar as the 5 yearold rape, I don't see any back down from the ABC on that being evidenced by an attending Doctor, merely the report confused two children? Apparently adult "skin on (child) skin" molestation is not of concern to the Federal govt, but gravitas to State govts. But eh, they are third world kids ...who gives a sh1te.

Was the ABC right or was it wrong ?Is that Pezzullo that's mentioned; is that the same Pezzullo? of Australian Boarder Force(ABF) who wants Jack booted goon squads marching the suburbs demanding to 'ze your paperz' in those 'oh so fetching' black uniforms in the infamous 'Operation Fortitude' farce.

A radiologist wanted in the United States on a child sex charge was hired by the detention health care contractor on Christmas Island to provide medical care for asylum seekers.
A Guardian Australia investigation has uncovered several other instances of medical practitioners with question marks against their record employed in onshore and offshore detention centres.
