I have been involved writing up an experts report for a farmer east of us.
The leasee over a period of time has pretty well destroyed the place.
The lawyer certainly knows how to drag the chain, so over the holiday period I travelled to the farm and spent a day there inspecting every inch so I could have the report to him in time to be presented to the Central Court.
Found out yesterday he still hasn't gone through it and then informed me well there's no rush.
I was under the impression it has to be on the Court table by Jan 31.
And the bill for this slow train keeps climbing.
 
After 6 attempts and at an expense levelled to his client, I am hopeful that this final signed effort will be the last, that is until it goes to court. Talk about the golden goose. These lawyers certainly know how to hurt the hip pocket nerve severely
 
So after 6 weeks of writing and re-writing this report, I finally managed to sing the three relevant pages (total number of pages all up is 11), but I am not holding my breath that this exercise of complete.
The lawyers parting words were I may need a bit more info.
And so the bill to his client will keep on keeping on.
Mine I have set at 16 hours even though it is more like 30.
 
The system seems based on keeping its own ecosystem of leeches in business. Lawyers are definitely on a different planet. Although there's some brilliant younger lawyers coming through that are both compassionate and thoughtful to the process.
Some of the older guys are really really terrible.

Fortunately, it's not me that has to pay the bill, but it has got up into the tens of thousands with not too much to show for that sum of money.

I've delved into some law. You can get a decent grasp by sitting in on open courts. Really is a lot of horse trading and has little to do with the truth.

Exactly as you say. Going to the expense of affidavits, expert witnesses, collating evidence and whatnot are a complete waste of time and money.

Seriously. It's all based on these set of guidelines where truth doesn't play a part, only easiest way foreword. Context is completely lost and a lot of people are usually forced into pleading guilty unless you got the dosh.

Guy I know was ripped off $6 million and he ran out of money for the lawyer before the business partner he was suing and had to stop.

I have been asked to be an expert witness. Man o' man finished up as the lawyers thoughts and words not mine. Some of the crap "I suggest blah blah, It might be advisable to word it in this way and so on.

Well what I am involved with hasn't got to court yet. 8 months of not much happening at a serious cost.
 
After many attempts to get the approval of the "silk" for my experts report it has finally got the nod.
I am of the opinion it would have been so much easier if he just wrote it up and I signed, because it is basically his words anyway.
With phrases that came at me like "I would suggest" I feel that this word could be changed to whatever and so on.
I think the "best" one was changing "the" to "this" which is what I had in the first place.
What a scam, the owner of the property must be cringing every time the "fee" comes in.

This is a common tactic. A plaintiff in a superior economic position delays a matter long enough through excessive applications etc. until the weaker defendant runs out of money and can no longer defend the matter. Plaintiff wins by default. Justice is mostly for the rich and powerful. For the average person, it's a financial meat grinder.
 
I have been an expert witness a few times now. Once you have done one you get to understand the way it has to be presented.

As for lawyers, especially barristers, they have by far the strongest and powerful union in the country but they don't call it a union.

No other profession can fix prices and conduct restrictive trade practices without breaking the law. Somehow they can completely evade it.

And zero recourse. The Law society is a joke is basically a protection racket for lawyers.
