Speeding Fines Proven Unlawful

In a landmark case in South Australia the revenue raising speeding fine of a bloke called Kenneth Bulgin has been overturned.

This may open the floodgates for further defence of these dreadful imposts on motorists, truckies and motorbike riders.

And its about time. The fines do nothing but raise revenue and keep coppers away from chasing dangerous drivers and criminals.

Just came back home and quite a number of cars flew past me on 100 k road, while I was just under the limit.

Challenges are good 'revenue raising' for legal practitioners while riders and drivers can be lured to save the points and or fine.

I honestly believe that MAJORITY of drivers goes just above or well above the posted speed limit then when clipped find number of ways to be scot-free.

Nobody has to agree with me and I am not going to argue with anybody, I am well past trying to argue the obvious.

I couldn't agree more mate.

How many times though have you been stuck behind some muppet doing 95kph and been forced to do 110/115 just to overtake them.

The silly bastards always seem to accelerate when you are committed to overtaking them.

Apropos revenue collection, the coppers are sick and tired of doing it.

I have nearly been involved in a head-on smash due to overtaking a car that repeatedly speeded up and slowed down, thus preventing me from getting back in the correct lane either in front of or behind that car.

That's the sort of driver I'd like to see Police issuing some pretty heavy fines to - an attitude like that will kill someone eventually.

I ended up driving behind them at about 60 - 70 km/h (in a 110 zone) until the next overtaking lane and then floored it.:(

The coppers should be chasing dangerous drivers like the person you described above.

My Arnage has a top speed of 270kph.

I'd be lucky to get anywhere near the low 200's once or twice a year.

I've got a story along these lines. Travelling along the south gippsland highway on a long straight section heading into Leongatha. the guy in front is sitting b/w 70 / 80kmh (100 zone) behind my is an unmarked police car ( I had spotted him earlier). I know I am tempting fate but I decide to take the risk and ovetake the bozo in front. There is oncoming traffic but it is safe to overtake. I get up alongside Mr bozo quite quickly, who seeing me coming, of course, speeds up, I edge up to a tad over 100 - it becomes clear that I am not going to be able to get passed him before having a head on with the approaching traffic so I brake and pull back in behind him.

Flashing lights in my mirror, great, I think, Mr plod has had a prime view of what the bozo got up to, endangering life etc. But hang on - he doesn't go around me he seems to be targetting me! WTF!

So I pull over and he gives me a breath test and asks me what I was doing, I explained that I was overtaking and the other guy sped up as he would have no doubt observed. I then get told that the bozo is entitled to do whatever speed he wants and that it is up to me as the overtaker to make sure it is safe to do so and I should have waited until it was 'safe' to overtake! I've never won an argument with a policeman so I didn't bother engaging him. No ticket as I hadn't been speeding, but he did wake up my little girl who then screamed all the way home.
 
Am I the only one who thought this thread was about ASX price 'speeding fines'?

Blatant revenue raising speeding fines (the road traffic ones) are annoying, although I can't complain, I have never had one, and in the last 15 years have only had one speeding fine (I must admit, it was deserved).

This type of behaviour is OFFENCE at least in NSW, but having perpetrator caught and fined is another story if car behind one like that is not Police car or unmarked Police car.

Datsun Disguise's post is another worry, and hard to explain why Police Officer didn’t notice speeding up specifically while being overtaken and that it is deadly dangerous manoeuvre if without being overtaken driver is quite happy to drive slowly.
 
My thought at the time was he was probably paying too much attention to his radar, waiting for me to break the 100.0567 kmh mark (or whatever the threshold is these days.)

This happened about 5 years ago and it still makes me angry!!

Re speeding in general, given the choice between having someone approaching me at 110 or 120 - but paying attention to the road ahead - and someone approaching me at 100 and being more interested in making sure the speedo needle doesn't edge over 100, I'll take thge first guy every time.

Speed is not the killer (it's the sudden stop at the end...) it is lack of attention to road conditions, other traffic, discourteousness, road rage and suicide.

If our preferences made any difference in this matter I would happily agree with you.

Unfortunately, common sense on Police part or rather lack of it and some speed meter accuracy tolerances play big part in my: ‘just under the posted speed limit’ driving.

It used to be less than 10% over the speed limit.

However after Police going more and more ‘accurate’ and Police Minister declaring that any speed limit violation is speed limit violation followed that anybody booked 1 km over speed limit can personally write to him and he will happily waive the fine and make sure that points are reinstated, made me change my driving habit.

Having said that it is just under the speed limit and definitely I am not increasing my speed while being overtaken, on single lane roads I actually ease off a bit to make overtaking manoeuvre as quick as possible as this is potentially VERY DANGEROUS MANOEUVRE despite that we do it or take part in it and don’t think much about it.

reminds me of a slightly humourous similar instance.

I once followed a marked police car on the F3, from North Sydney to almost Gosford..ie 30mins.

He kept to the left, JUST below the speed limit, on the freeway.

Cars would come rushing impatiently up the right hand lanes, see the cop car, brake hard, and join the queue.

Eventually one young guy in a fast car came flashing by, without a sideways glance. Cop sirened him over immediately.

I was so happy

just letting you all know that if any of you get knocked off with an unmarked car with the lidar,go to court as it is against the S.O.P. standard operational procedures.as to operate a lidar the vehicle MUST be fitted with a cable shield to prevent interference.

i was supplied with a copyof the nsw police guidelines & SOP so its not a rumour ive got it on cd.

im off to toronto on tuesday after sgt walloper tracked me around 2 bends & over the trees(both against guidelines) at 117kmh in a 100kmh speed limited truck.

also the sop clearly states it is mandatory to have a clear line of sight,so him hiding in the bushes is not allowed,plod says i got ya 117 i said get ya hand off it,truck is speed limited...oh well limiter must be faulty,i said well defect me now & ill get a mechanic from gilbert & roach in beresfield to come inspect the limiter.he wouldnt listen to me,i drive the oldest truck in the sydney depot,2004 western star...deadset cant do over 100kmh on the flat.

asf trendsetters if its an unmarked just do what i did...ill see you in court,gives me & the rest of us profesional drivers big shtzens as this is our
livelihoods.if i lose my licence i cant pay my rent etc.

i might see if i can post the stuff on here if allowed...TB

Yea, what is it with people that do that? It happens with overtaking lanes too. They sit on 90ks in single lanes then when you try to overtake them at an overtaking lane, they speed up to 110-120ks. Fair enough, back to single lanes again and they're back at 90ks. Drives me nuts. Make up yer friggen mind!!!! :banghead:
 
in 2003 i was in melbourne doing an employee safety rep course and our instructor was telling the class that he was previously employed as a safety officer in the car manufacturing industry (wont say which one) and that the car making industry WILL NOT GUARENTEE A CARS SPEEDO WITHIN + OR - 10%!
thats for a brand spanking new car straight off the production line! if thats the case how can anyone be booked for speeding within those limits? lets face it (even without that being the case) just changing tyres on your car can alter your speedo accuracy!
i got booked by a b*stard speed camera contractor just near bairnsdale hiding in the bushes on the only decent bit of straight road, overtaking a caravan who was doing about 80kmh... my speed? 104kmh! driving a 1984 diesel patrol ute!
cant agree more that its just blatant revenue raising, and i agree totally with the comment about prefering drivers who are a bit over the limit but aware of the traffic conditions to ones who are so focussed on their speedo needle they dont know whats going on around them!
thats my rant for the day! ;)

more so when im pulling 60 tonne in a b/double,im then left out in the right hand lane KNOWING I GOTTA GET BACK IN TO GET THE CARS GOING AGAIN.

HAPPENS ALL THE TIME.:banghead:...

WHAT happens then?all the cars start to zap up your inside blindside...
many car drivers have not a clue...very dangerous...tb

You get on the phone mate to Eddie Maguire, and get him to ask the PM, and if the silly bigger replies as he probably would, I would stop the truck in the middle of the highway and get out and start walking, as the country will by then be well and truly stuffed.
