I've only skimmed through the judgement but this paragraph may indicate that simply providing a software package is not in itself financial advice...Bolding mine.It still is difficult to see how ASIC arrived at the answer they gave you. Surely any marketing material used by the software vendor would satisfy the first requirement, with the actual software satisfying the second.
